‘Neither judiciary, nor executive, but it’s the Constitution that is supreme’: CJI BR Gavai

Speaking at a felicitation programme by the Bar Council of Maharashtra and Goa on Sunday, Chief Justice of India (CJI) BR Gavai said, “In the 75 years since we adopted the Constitution, our democracy's three pillars – Executive, Legislative, and Judiciary – have delivered the social and economic justice that was expected of them.”


He added that today India is strong because of the Kesavananda Bharati judgement that laid down the basic structure and doctrine. “All three pillars of democracy are working within the sphere prescribed to them... I am happy that since the Kesavananda Bharati judgement, the country is not just strong but also progressive in terms of economic and social equality.”


The CJI further said that when he was asked which one is supreme – judiciary or executive? He said, “neither the judiciary nor executive nor the parliament is supreme. But it is the Constitution that is supreme. All three pillars need to work as per the Constitution.”
